Article 3 – Applicability

  1. These General Terms and Conditions apply to every offer made by Logidon and every agreement concluded between Logidon and a Consumer.

  2. Before the agreement is concluded, these General Terms and Conditions will be made available electronically in a way that allows the Consumer to save and access them later.

  3. Where specific product or promotional terms apply in addition to these Terms and Conditions, they will be clearly communicated before the order is placed.

  4. Mandatory statutory consumer rights always take precedence over any conflicting provision in these Terms and Conditions.

  5. The version of these Terms and Conditions in force at the time the agreement is concluded applies to the order.

Article 4 – Offers and Product Information

  1. Logidon aims to describe the products offered as completely and accurately as possible.

  2. Product images are intended to provide a true representation. Minor colour differences caused by screen settings do not in themselves constitute a defect, provided that the agreed characteristics of the product are not affected.

  3. Obvious mistakes, evident pricing errors or clear typographical errors are not binding where an average Consumer should reasonably have recognised that an error had occurred.

  4. The main product characteristics, price, applicable shipping costs and other relevant information are displayed clearly before the order is completed.

  5. If a product becomes unavailable after an order has been placed, Logidon will inform the Consumer as soon as reasonably possible. Any amount already paid for an unavailable product will be refunded.

Article 5 – Formation of the Agreement

  1. The agreement is concluded when the Consumer completes the order and Logidon confirms the order electronically.

  2. Logidon will acknowledge receipt of the order electronically.

  3. Logidon takes appropriate technical and organisational measures to protect electronic payments and personal data.

  4. Agreements are concluded subject to the actual availability of the ordered products. If performance proves impossible, Logidon will inform the Consumer without undue delay and refund any relevant amounts paid.

Article 6 – Prices, VAT and Shipping Costs

  1. Consumer prices are displayed including applicable VAT unless explicitly stated otherwise.

  2. Shipping to the Netherlands, Belgium and Germany is free of charge.

  3. Shipping charges may apply to other countries to which Logidon delivers. The applicable shipping costs will be clearly shown at checkout before the Consumer completes the order.

  4. Logidon will not charge additional costs that the Consumer has not expressly agreed to before concluding the agreement.

  5. Discount codes and promotions are subject to the terms communicated with the relevant promotion.

Article 7 – Payment

  1. The available payment methods are shown during checkout.

  2. Payment is made in accordance with the conditions of the payment method selected by the Consumer.

  3. Where a payment service provider applies additional terms, those terms are applied separately by that provider.

  4. Any inaccuracies in payment details should be reported to Logidon as soon as possible.

Article 8 – Delivery and Transport

  1. Logidon will process and dispatch orders with due care.

  2. Expected delivery times vary according to the destination. The current expected delivery period is displayed before the order is completed or alongside the relevant shipping option.

  3. If no specific delivery period has been agreed, delivery will take place no later than 30 days after the agreement is concluded.

  4. If Logidon fails to deliver within the agreed or statutory period, the Consumer may grant Logidon an additional reasonable period for delivery. If delivery still does not take place within that additional period, the Consumer may terminate the agreement and is entitled to reimbursement.

  5. No additional period is required where Logidon has refused to deliver or where delivery by a specific date was essential and this was made clear before the agreement was concluded.

  6. Depending on the size and nature of the products, an order may be delivered in more than one parcel.

  7. The risk of loss or damage remains with Logidon until the Consumer, or a third party designated by the Consumer other than the carrier, receives the products.

Article 9 – Right of Withdrawal and Free Returns

  1. For distance contracts, the Consumer has the right to withdraw from the agreement without giving any reason within 14 days from the day on which the Consumer, or a third party designated by the Consumer other than the carrier, receives the product.

  2. If several products from one order are delivered separately, the withdrawal period begins after the final product has been received.

  3. The Consumer may exercise the right of withdrawal:

    • through Logidon's online withdrawal function;

    • by using the model withdrawal form;

    • by emailing info@logidon.com; or

    • by any other unequivocal statement clearly expressing the decision to withdraw.

  4. Use of the model withdrawal form is optional.

  5. After notifying Logidon of the withdrawal, the Consumer has a further 14 days to return the products unless Logidon has offered to collect them.

  6. Returns within the statutory withdrawal period are free of charge when the Consumer uses the return method provided or designated by Logidon.

  7. After registering the return, the Consumer will receive the applicable return instructions, return label or, where necessary, information about collection of larger products.

  8. For goods that cannot normally be returned by post because of their nature, Logidon may arrange collection.

  9. During the withdrawal period, the Consumer may inspect and assess the product in the same way as would reasonably be possible in a physical store.

  10. The Consumer is only liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

  11. Products should be adequately protected for return shipping. Use of the original packaging is recommended where reasonably possible, but is not a condition for exercising the statutory right of withdrawal.

Article 10 – Reimbursement Following Withdrawal

  1. Following a valid withdrawal, Logidon will reimburse all amounts that must legally be refunded no later than 14 days after being informed of the Consumer's decision to withdraw.

  2. Where the entire order is withdrawn, the reimbursement includes the cost of the least expensive standard delivery originally offered, where shipping costs were charged.

  3. Additional costs resulting from the Consumer expressly choosing a delivery method more expensive than the least expensive standard delivery do not have to be reimbursed.

  4. Reimbursement will be made using the same payment method used for the original transaction unless the Consumer expressly agrees otherwise.

  5. Logidon may withhold reimbursement until the products have been received or until the Consumer provides evidence that the products have been returned, whichever occurs first.

  6. Where Logidon has offered to collect the goods, reimbursement will be processed in accordance with the applicable statutory rules.

Article 11 – Exceptions to the Right of Withdrawal

The right of withdrawal does not apply where and to the extent that a statutory exception applies. This may include:

  1. products made to the Consumer's specifications or clearly personalised;

  2. sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery;

  3. other goods or services for which applicable law expressly excludes the right of withdrawal.

Where an exception applies to a product, this will be clearly stated before the agreement is concluded.

Article 12 – Statutory Conformity and Guarantee

  1. Logidon warrants that the products supplied comply with the agreement and possess the characteristics that the Consumer may reasonably expect under the agreement and applicable law.

  2. Statutory conformity rights are not limited by any manufacturer's warranty, seller's warranty or other commercial guarantee.

  3. If a product does not conform to the agreement, the Consumer may rely on the remedies provided by applicable law, including free repair or replacement and, where legally available, a price reduction or termination of the agreement.

  4. Statutory guarantee claims are handled free of charge. Where applicable, this includes necessary shipping, return, examination, material and labour costs.

  5. Consumers are requested to report defects as soon as reasonably possible after discovering them. Under Dutch law, notification within two months after discovery is in any event considered timely.

  6. Normal wear and tear, improper use or damage demonstrably caused by the Consumer does not in itself constitute a defect for which Logidon is responsible.

  7. A repair, modification or other action undertaken by the Consumer will only affect statutory rights to the extent that Logidon can demonstrate that it caused or aggravated the reported defect.

Article 13 – Incorrect, Damaged or Incomplete Deliveries

  1. If a product arrives damaged, incorrect or incomplete, the Consumer may contact Logidon at info@logidon.com.

  2. Providing the order number, a description of the issue and, where relevant, photographs will assist Logidon in resolving the matter promptly.

  3. Failure to report transport damage immediately does not affect the Consumer's statutory rights.

  4. Where an order consists of several parcels, each parcel may have a separate tracking number.

Article 14 – Complaints

  1. Complaints concerning an order, product or service may be submitted through info@logidon.com or through Logidon's customer service contact options.

  2. Logidon will handle complaints carefully and aims to provide a substantive response within 14 days.

  3. If a complaint requires more time to investigate, the Consumer will receive an acknowledgement within this period together with an indication of the expected response time.

  4. Logidon's internal complaints procedure does not restrict the Consumer's statutory rights.

  5. If a dispute cannot be resolved directly, the Consumer retains access to any legally available recognised alternative dispute resolution procedure and to the competent courts.

Article 15 – Personal Data

Logidon processes personal data in accordance with applicable data protection legislation and the Privacy Policy published on the online store.

Article 16 – Governing Law and Disputes

  1. Agreements with Logidon are governed by Dutch law.

  2. This choice of law does not deprive a Consumer resident in another country of the protection provided by mandatory provisions of the law that would have applied in the absence of this choice.

  3. Disputes may be brought before any court having jurisdiction under the applicable national and European jurisdiction rules.

  4. Where Logidon is legally required to participate in a recognised alternative dispute resolution procedure, or has voluntarily committed to such a procedure, the Consumer will be informed as required by law.

Article 17 – Final Provisions

  1. If any provision of these Terms and Conditions is found to be wholly or partially invalid or unenforceable, the remaining provisions remain in force.

  2. The applicable statutory rule will apply in place of the invalid provision.

  3. Amendments to these Terms and Conditions apply only to future agreements unless the Consumer expressly agrees otherwise.

  4. Mandatory consumer rights cannot be excluded or restricted by these Terms and Conditions.
